Wal-mart is requesting the U.S. Supreme Court weigh in on its years-long fight to be able to sell spirits in Texas. In previous decisions, the lower courts were split on whether it is a violation of the Commerce Clause for Texas to deny public companies like Wal-mart the ability to sell spirits. As a result, Wal-mart is leaning more on a “discriminatory effects” challenge to the state’s laws in its appeal to the Supreme Court.
This Supreme Court Justices will likely decide whether to hear the case in late summer or fall.
